2. Withdrawal period
   VasyFan is not responsible for any damage or loss, direct and / or indirect, deriving from the sale of goods and services offered on the website www.vasyfan.com, even for delayed and / or non-delivery of the product, nor for the correspondence of the goods to the specifications published on the site, nor for any other fact not directly attributable to VasyFan. Many components such as batteries and electric motors are potentially dangerous to things, animals or people. By purchasing these products the buyer assumes all responsibility for the risks, accepting not to hold the manufacturer responsible in any way.

3. Technical information
   Some technical information included in the Internet site: www.vasyfan.com are obtained from the information published by the manufacturers of the goods included. www.vasyfan.com, therefore, reserves the right to modify / adapt the technical and dimensional information of the products based on what will be communicated by the manufacturers, even without any prior notice. www.vasyfan.com is not responsible for any errors in data entry and technical specifications relating to the products inserted.

4. Prices
   All prices posted on the website www.vasyfan.com are inclusive of VAT unless otherwise indicated. Prices can be changed at any time and without notice.

5. Shipping and Delivery
   Shipments, unless otherwise agreed, will be made by our courier. Shipping costs include packaging, insurance (when required) and delivery. Once the goods have been delivered to the courier, Vasyfan is no longer responsible for delays due to causes previously described and / or other reasons related to the courier's logistical causes. Vasyfan is not required to inform the recipient about the status of the shipment during its transit, it is in the recipient's interest to contact the carrier to whom Vasyfan has entrusted the goods to receive information from it.

6. Risk and ownership
   At the time of packaging, the goods are checked and leave our warehouse only if they apparently do not show defects or malfunctions. Upon delivery of the goods, the Customer must verify the integrity of the packages and the quantitative and qualitative correspondence with what is indicated in the invoice (in the case of a company or natural person with a VAT number). Furthermore, the Customer is required to check the integrity of the adhesive tape on the packaging. In case of discrepancy or visible damage to the packaging or tampering, the Customer MUST refuse the goods, the same must be reported on the accompanying waybill. In case of suspicion of damage, the Customer must affix the reserve signature to verify the integrity of the goods at the time of delivery. In the event that the Customer verifies damage to the goods after delivery, the same must provide Vasyfan with photos of the protective wrapping as evidence of the state of the packaging at the time of delivery and therefore accepted intact and send within two days the notification of the anomaly via email, any insurance and / or reimbursement by Vasyfan lapses in cases where the Customer fails to provide the necessary evidence to ascertain the state of the packaging or if it has been thrown away. Even if the packaging is intact, the goods must be checked within seven days of receipt. For each declaration, the customer assumes full responsibility for what is declared. Where Vasyfan ships goods with insurance, guarantees the compensation of the value of the goods or the return of one of the same characteristics, only in case of loss or theft.

7. Payments
   The goods supplied can be paid for by bank transfer. 8. Right to cancel orders
   The Customer may request the cancellation of the order and Vasyfan reserves the acceptance of the cancellation of the same. The cancellation and acceptance of the same must take place in writing no later than 5 days. The right to cancel the order is precluded to the Customer in the event that the goods have been expressly ordered by Vasyfan from its supplier and the latter has not accepted, in turn, the cancellation of the order.

9. Returns Goods
   The return of the goods to Vasyfan must be requested in writing, indicating the reasons for the request, citing the references of the invoice and / or DDT and must be expressly authorized. The goods to be returned must be in perfect condition, in the original packaging and shipped free port to our warehouse. All costs of returning the products are expressly charged to the Customer, who, through his own forwarder, will forward them to the address that will be provided. It is understood that the transport risks for the return of the items are fully borne by the Customer, the goods will be checked below and if free from tampering or breakages resulting from the return of the transport or by the customer in case the goods have been tampered with or arrive damaged , the Customer will lose all rights, the goods will be returned to the customer with an increase in shipping costs for the return.

10 – Guarantees
   All products marketed by Vasyfan are covered by a regular manufacturer / importer warranty. Vasyfan is not responsible for the characteristics indicated for products imported by manufacturers. To take advantage of the guarantee, it is necessary to keep the invoice and any original packaging. The warranty has a duration of 24 months from the date of receipt of the goods.

11 - Processing of Personal Data
   Pursuant to Law 31.12.1996 n. 675, the customer acknowledges that the 'personal data' communicated and / or exchanged, even in the pre-contractual information phase, will be processed pursuant to, for the effects and with the purposes referred to in art. 12, paragraph 1, letters b), c), d) and f) of Law no. 675/96 and subsequent amendments and additions. Furthermore, it is understood that the Customer expressly consents to the transfer of 'personal data' pursuant to and for the purposes of art. 28 paragraph 4 letter a) of Law no. 675/96 and, in any case, to their communication and dissemination pursuant to and for the purposes of art. 20 paragraph 1 letter a) of the aforementioned law.

12 - Right of Withdrawal
   The Legislative Decree n. 185 of 22/05/1999 provides for the possibility for the purchaser to exercise the right of withdrawal. Therefore, remote purchases made by telephone or via the Internet are included in this case, whether they are delivered at home or collected at the company's headquarters or at a point of presence in the territory.

Who it applies to:
To natural persons (consumers) who act for purposes that can be considered unrelated to their commercial activity. Therefore, purchases made by retailers and companies are excluded from the right of withdrawal.

2. Responsabilità
   VasyFan non è responsabile di alcun danno o perdita, diretta e/o indiretta, derivante dalla vendita di beni e servizi proposti nel sito www.vasyfan.com, anche per ritardata e/o mancata consegna del prodotto, ne per la corrispondenza della merce alle specifiche pubblicate nel sito, ne per qualsiasi altro fatto non imputabile in via diretta a VasyFan. Molti componenti come batterie e motori elettrici sono potenzialmente pericolosi per cose, animali o persone. Acquistando questi prodotti l'acquirente si assume tutte le responsabilità per i rischi, accettando di non ritenere in alcun modo responsabile il produttore.

4. Prezzi
   Tutti i prezzi inseriti nel sito www.vasyfan.com, sono da intendersi IVA compresa salvo quanto diversamente indicato. I prezzi possono essere modificati in qualsiasi momento e senza alcun preavviso.

5. Spedizioni e Consegna
   Le spedizioni, salvo diversi accordi, saranno effettuate a mezzo nostro corriere. Le spese di spedizione sono comprensive di imballaggio, assicurazione (quando richiesta) e consegna. Una volta consegnata la merce al corriere Vasyfan non si ritiene più responsabile di ritardi dovuti a cause precedentemente descritte e/o altri motivi legati a cause logistiche del corriere. Vasyfan non è tenuta ad informare il destinatario sullo stato della spedizione durante il suo transito, è interesse del destinatario contattare eventualmente il trasportatore a cui Vasyfan ha affidato la merce per ricevere da esso informazioni.

6. Rischio e proprietà
   Al momento del confezionamento la merce viene controllata e parte dal nostro magazzino solo se apparentemente non presenta vizi o malfunzionamenti. Al momento della consegna della merce, il Cliente deve verificare l'integrità dei colli e la corrispondenza quantitativa e qualitativa con quanto indicato nella fattura (in caso di azienda o persona fisica con partita IVA). Inoltre il Cliente è tenuto a verificare l'integrità del nastro adesivo sull'imballo. In caso di difformità o danneggiamento visibile dell'imballo o manomissione il Cliente DEVE rifiutare la merce, la stessa dovrà essere segnalata sulla lettera di vettura accompagnatoria. Nel caso di sospetto danneggiamento il Cliente deve apporre all'atto della consegna la firma di riservo di verifica dell'integrità dei beni. Nel caso in cui il Cliente verifichi dopo la consegna il danneggiamento della merce lo stesso deve fornire a Vasyfan le foto dell'involucro protettivo a testimonianza dello stato dell'imballo al momento della consegna e quindi accettato integro ed inviare entro due giorni la segnalazione dell'anomalia via email, decade ogni assicurazione e/o rimborso da parte di Vasyfan nei casi in cui il Cliente non riesca a fornire le prove necessarie ad accertare lo stato dell'imballo o se lo stesso sia stato buttato. Pur in presenza di imballo integro, la merce dovrà essere verificata entro sette giorni dal ricevimento. Per ogni dichiarazione, il cliente si assume la responsabilità piena di quanto dichiarato. Vasyfan lì dove spedisce merce con assicurazione, garantisce il risarcimento del valore del bene o la rispedizione di uno delle stesse caratteristiche, solo in caso di smarrimento o furto.

7. Pagamenti
   Le merci fornite potranno essere pagate a mezzo bonifico bancario. 8. Diritto di annullamento degli ordini
   Il Cliente potrà chiedere l'annullamento dell'ordine e Vasyfan si riserva l'accettazione dell'annullamento dello stesso. L'annullamento e l'accettazione dello stesso dovranno avvenire in forma scritta entro e non oltre 5 giorni. La facoltà di annullamento dell'ordine è preclusa al Cliente nell'ipotesi in cui la merce sia stata espressamente ordinata da Vasyfan al proprio fornitore e questi non abbia accettato, a sua volta, l'annullamento dell'ordine.

9. Restituzioni Merci
   La restituzione delle merci a Vasyfan dovrà essere richiesta in forma scritta, con l'indicazione dei motivi della richiesta stessa, citando i riferimenti della fatture e/o DDT e dovrà essere espressamente autorizzata. La merce da restituire, dovrà essere in perfetto stato, nell'imballo originale e spedita in porto franco al nostro magazzino. Tutti i costi di ritorno dei prodotti sono espressamente a carico del Cliente, il quale, tramite proprio spedizioniere, provvederà all'inoltro dei medesimi al indirizzo che verrà fornito. Resta inteso che i rischi del trasporto per la restituzione degli articoli sono integralmente a carico del Cliente, la merce sarà di seguito controllata e se priva di manomissioni o rotture derivate dal reso del trasporto o dal cliente nel caso la merce sia stata manomessa o arrivi danneggiata, decadrà ogni diritto da parte del Cliente, la merce sarà rispedita al cliente con aggravio di spese di spedizione per la restituzione.

10 – Garanzie
   Tutti i prodotto commercializzati da Vasyfan sono coperti da regolare garanzia del produttore/importatore. Vasyfan non si rende responsabile delle caratteristiche indicate per i prodotti importati dai produttori. Per avvalersi della garanzia è necessario conservare la fattura ed eventuali imballi originali. La garanzia ha una durata di 24 mesi dalla data di ricezione della merce.

11 - Trattamento dei Dati Personali
   Ai sensi della Legge 31.12.1996 n. 675, il cliente da atto che i 'dati personali' comunicati e/o scambiati, anche in fase di informative precontrattuali, formeranno oggetto di trattamento ai sensi, per gli effetti e con le finalità di cui all'art. 12, comma 1, lettere b), c), d) ed f) della Legge n. 675/96 e successive modificazioni ed integrazioni. Resta, inoltre, inteso che il Cliente espressamente acconsente al trasferimento dei 'dati personali' ai sensi e per gli effetti dell'art. 28 comma 4 lettera a) della Legge n. 675/96 e, comunque, alla loro comunicazione e diffusione ai sensi e per gli effetti dell'art. 20 comma 1 lettera a) della citata legge.

12 - Diritto di Recesso
   Il D.Lgs n. 185 del 22/05/1999 prevede la possibilità da parte dell'acquirente di esercitare il diritto di recesso. Rientrano quindi in questo caso gli acquisti a distanza fatti tramite telefono, o tramite Internet siano essi consegnati a domicilio oppure ritirati presso la sede della società o presso un punto di presenza sul territorio.

A chi si applica:
Alle persone fisiche (consumatori) che agiscono per scopi che possono considerarsi estranei alla propria attività commerciale. Sono perciò esclusi dal diritto di recesso, gli acquisti effettuati da rivenditori e da aziende.
